I bought a New Nin 3ds XL that has firmware 9.9 and I got A 3ds XL with 10.5
R.I.P chances of CFW. I got softbricked and I couldn't get the internet browser or system settings to work. Had to recovery mode and update to 10.5 Sadly. I'll wait for a safer option.
